Welcome to TrackMyPets.com ("Website"), which is owned and operated by Webapps,LLC ("Company" “us” or “our”). Please review the entire Agreement carefully. By registering to use our Service online, you electronically sign this Agreement and agree to be legally bound by all of the terms, conditions referenced in this Agreement. Although we may make changes to our Service and this Agreement, all changes will be posted on this link and will be enforced from the date of the revision or change forward without further notice to you. You must read and agree with all of the terms and conditions contained in this Agreement and the posted privacy policy then in effect ("Privacy Policy"), which is incorporated by reference, before you use the Service and periodically thereafter. If you do not agree to be bound by this Agreement or the Privacy Policy, you are not authorized to access our Website or use our Service. Our Service is available only in the United States. If you access or use our Service, you are representing and warranting that you are a United States Citizen or resident and 18 years of age or older. This Agreement contains an agreement to arbitrate all claims, restrict class action participation and disclaimers of warranties and liability.

The following Terms of Service Agreement ("Agreement") governs your access to and use of our Website and the Services made available to you by Company ("Service").

1. Services.

Company provides an online service to register ownership of your pet in the event your pet is stolen, missing or lost. Upon registration, Company will send you an identification tag which has a unique serial number identifying the pet to your registration information. We ask that you pay $4.95 for shipping and handling for the tag. Thereafter, your information is placed in an online database so that when anyone contacts us regarding the location of your pet, we will immediately notify you of the location of your pet and provide you with contact information from the person or shelter that has your pet so that you may contact them directly. We do not provide your registration information to the person or institution which has your pet. You may cancel our Service by going to your My Account page and clicking the Delete Account link.

2. Your Obligations.

You are required to provide us with your current contact information through our online registration. In addition, it is your obligation to keep this contact information current. You must also comply with all applicable laws in connection with your access to and use of our Website and Service. You also agree to any additional instructions or limitations as may be set forth in any written or on-line notice from us. You represent and warrant to us that you will not use our Website or Service for any purpose that is unlawful or prohibited by the Agreement. Use of our Website and Services is for your personal and non-commercial use, and Company does not grant any express or implied rights for any other purpose. You may only register a pet that you own and may not use our Service for any commercial purpose. Our Service is not transferrable.

You are required to complete an enrollment form to the Services. You must complete the registration process by providing us with current, complete and accurate information as prompted by the online enrollment form. You are entirely responsible for maintaining the confidentiality of your account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Company immediately of any unauthorized use of your account or any other breach of security. Company will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge. However, you could be held liable for losses incurred by Company or another party due to someone else using your account. You may not use anyone else's account at any time, without the permission of the account holder.

3. Privacy of Your Information.

You authorize Company to collect, use and share your personal information in accordance with our posted Privacy Policy which is incorporated herein as though fully set forth.

TCPA Consent. Notwithstanding current or prior election to opt in or opt out of receiving telemarketing calls or SMS messages (including text messages) from us, our agents, representatives, affiliates, or anyone calling on our behalf, you expressly consent to be contacted by us, our agents, representatives, affiliates, or anyone calling on our behalf for any and all purposes arising out of or relating to your pet or promotions related to our Website and Service, at any telephone number, or physical or electronic address you provide or at which you may be reached. You agree we may contact you in any way, including SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using auto telephone dialing system or an automatic texting system. Automated messages may be played when the telephone is answered, whether by you or someone else. In the event that an agent or representative calls, he or she may also leave a message on your answering machine, voice mail, or send one via text. You consent to receive SMS messages (including text messages), calls and messages (including prerecorded and artificial voice and autodialed) from us, our agents, representatives, affiliates or anyone calling on our behalf at the specific number(s) you have provided to us, or numbers we can reasonably associate with your account, with information or questions about your registration and Pet or to notify you of your found Pet. You certify, warrant and represent that the telephone numbers that you have provided to us are your contact numbers. You represent that you are permitted to receive calls at each of the telephone numbers you have provided to us. You agree to promptly alert us whenever you stop using a particular telephone number. Your cellular or mobile telephone provider will charge you according to the type of plan you carry. You also agree that we may contact you by e-mail, using any email address you have provided to us or that you provide to us in the future.

4. Billing Terms.
  1. a) Fees
    When you enroll in our Service, you authorize Company to charge your credit card $4.95 shipping and handling for the tag to attach to your pet’s collar. There are no other fees or subscription fees. The shipping and handling charges are non-refundable. If you do not receive your tag, please contact us at CustomerService@TrackMyPets.com.
  2. b) Cancelation
    We will attempt to cancel your order if it has not yet been processed. To cancel an order not yet processed, please click on the cancel button for that order. This button is located at the bottom of your account page under the section labelled Order History. You cannot cancel an order via phone or email.
  3. c) Refunds
    Successfully canceled orders will generate an automatic refund of the associated shipping and handling fee. Although this refund process is automated, it could take a few days to be reflected on your credit card statement.
5. No Guarantee.

We do not and cannot guarantee that registration for or use of our Services will ensure the return of your pet. It is only one additional proactive step for you to obtain the return of your pet. Any and all information provided to you on our Website or through our newsletters or marketing whether by telephone, email, letter, facsimile, or other form of communication, is for informational purposes only.

6. Disclaimer of Warranties.

Except as expressly set forth in this Agreement, we are not responsible for any incorrect or inaccurate information or entry of information, whether caused by a user of our Website or by any of the equipment or programming associated with or utilized in connection with our Website or our Services or by any technical or human error which may occur in the processing of information received by us. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, information received or submitted in connection with our Website. We are not responsible for any problems, errors or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, or software, or any failure of email on account of technical problems or traffic congestion on the Internet or at our Website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from use of our Website or website content.

THE CONTENT AND ALL SERVICES ASSOCIATED WITH OUR SERVICES ARE PROVIDED TO YOU ON AN "AS-IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF OUR SERVICES OR THE INFORMATION, CONTENT, MATERIALS, SERVICES INCLUDED ON OR ASSOCIATED WITH OUR SERVICES INCLUDING ANY YOU MAY CHOOSE. YOU EXPRESSLY AGREE THAT YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK.

WE DO NOT MAKE, AND EXPRESSLY DISCLAIM, ANY REPRESENTATIONS, WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, CORRECTNESS, OR COMPLETENESS OF THE CONTENT OR THE SERVICES OR THE SAFETY, RELIABILITY, TITLE, TIMELINESS, COMPLETENESS, MERCHANTABILITY, CONFORMITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE CONTENT OR THE SERVICES AND PRODUCTS ASSOCIATED WITH OUR SERVICES. IT IS YOUR SOLE RESPONSIBILITY TO INDEPENDENTLY EVALUATE THE ACCURACY, CORRECTNESS OR COMPLETENESS OF THE CONTENT AND THE SERVICES AND PRODUCTS ASSOCIATED WITH OUR SERVICES. WE EXPRESSLY DISCLAIM ANY AND ALL LIABILITY FOR ANY CONTENT, OR SERVICES PROVIDED BY ANY CLIENT WHO HAS CONTACTED YOU AS A RESULT OF YOUR USE OF OUR SERVICES.

7. Limitation of Liability.

IN NO EVENT WILL WE, OUR PARENT, SUBSIDIARIES, PARTNERS, AGENTS, AFFILIATES, LICENSORS, SUCCESSORS AND ASSIGNS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, AND EMPLOYEES AND SHAREHOLDERS BE LIABLE TO ANY PARTY (i) FOR ANY INDIRECT, DIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR ANY OTHER DAMAGES ARISING IN ANY WAY OUT OF THE AVAILABILITY, USE, RELIANCE ON, OR INABILITY TO USE THE WEBSITE OR SERVICE, EVEN IF ALL SUCH PARTIES SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE; OR (ii) FOR ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN, OR DESTRUCTIVE PROPERTIES OF THE WEBSITE OR SERVICES. YOU AND WE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO OUR SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, OUR LIABILITY IN SUCH JURISDICTION SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Dispute Resolution and Preclusion of Class Action.

You and Company each agree that any and all disputes or claims that have arisen or may arise between you and us relating in any way to or arising out of this or previous versions of this Agreement, your use of or access to our Services, or any Product sold, offered, or purchased through our Service shall be resolved exclusively through final and binding arbitration through the American Arbitration Association, rather than in court.

Prohibition of Class and Representative Actions and Non-Individualized Relief

YOU AND WE AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND US AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S OR PARTY'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY'S INDIVIDUAL CLAIM(S). ANY RELIEF AWARDED CANNOT AFFECT OUR OTHER USERS.

9. Intellectual Property.

All intellectual property ownership and rights in the text, images, photographs, graphics, user interface, and other content provided on our Website (collectively “Content") are owned by Company or its third-party licensors to the full extent provided under the United States Copyright Act and all international copyright laws. You are authorized to make use of the Content for educational and non-commercial purposes only, provided that you maintain all copyright and other notices posted along with the Content. Any reproduction, copying, or redistribution of the Content for commercial purposes is strictly prohibited without Company's prior written consent. Requests for permission to reproduce any Content must be made to Company at CustomerService@TrackMyPets.com.

If you believe that something on our website has been copied in a way that constitutes copyright infringement, please provide Company's Copyright Agent with the following information: (i) identification of the copyrighted work claimed to have been infringed; (ii) identification of the allegedly infringing material on the Site that is requested to be removed; (iii) your name, address, and daytime telephone number, and an email address if available, so that Company may contact you to resolve; (v) a statement that you have a good faith belief that the use of the copyrighted work is not authorized by the copyright owner, its agent, or the law; (vi) a statement that the information in the notification is accurate and, under penalty of perjury, that the signatory is authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed; and (vii) an electronic or physical signature of the copyright owner or someone authorized on the owner's behalf to assert infringement of copyright and to submit the statement.

10. Right to Post Your Communications.

Except for your registration information which contains personal information and is governed by our posted Privacy Policy, any communications, photos or other material you send to us or post on our Website shall be considered non-confidential and non-proprietary. Company does not claim ownership of this type of information but by submitting your communication or other material to us or through our Website, you are granting Company a royalty free, non-revocable license to copy, disclose, distribute, incorporate, and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes with the agreement that no compensation of any type will be paid to you for use of the material.

You agree not to transmit, distribute, post, communicate or store information or other material on, to use or on our Website that belongs to or is copyrighted to another person; or infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; or is obscene, defamatory, threatening, harassing, abusive, hateful, slanderous or embarrassing to any other person or entity as determined by Company in its sole discretion; or constitutes advertisements or solicitations of business; or contains viruses, trojan horses, worms, time bombs, or other computer programming routines or engines that are intended to damage, interfere with, intercept or remove any Company or its user’s system, data or information.

You further agree not to violate or attempt to violate the security protocols set up for our Website, including but not limited to: (i) accessing data not intended for you; (ii) logging into a server or account that you are not authorized to access; (iii) attempting to probe, scan or test the vulnerability of our system or network or to breach security or authentication measures without proper authorization; (iv) or attempt to interfere with service to any user, host or network.

12. Third-Party Content and Links.

We may from time to time post third-party owned content, ads and links to other’s websites (collectively "Links"). Company does not endorse, sponsor, recommend, or otherwise accept responsibility for any Links. In addition, Links are not under the control of Company, and Company is not responsible for the content, terms or privacy practices of the Links. Company is providing third-party Links to you only as a convenience. The inclusion of such Links is not an endorsement by Company in favor of any third party. In addition, the Company may from time to time allow third parties to post content on or through our Website. Company may, but is not required to, review such content. 13. Changes to Website, terms and policies.

We reserve the right to change any information, feature or functions of our Services and Website without prior notice. 14. Acceptance of Terms.
  1. Electronic Signature. This Agreement is an electronic contract that governs your use of and access to our Website and Services. By checking the box on the enrollment screen, you acknowledge that you understand and agree to be legally bound by this Agreement and the posted Privacy Policy as well as the terms, conditions and notices contained or referenced herein. Checking the box creates an electronic signature that has the same legal force and effect as a handwritten signature.

When you check the box on the enrollment screen indicating your acceptance of the Agreement, you also consent to have the Agreement provided to you in electronic form and agree to receive information about your account electronically. Company reserves the right to send you information about your account by postal mail.
  3. Non-electronic Copy. You have the right to receive the Agreement in non-electronic form. You may request a non-electronic copy of the Agreement either before or after you electronically sign it.   4. Withdrawing Your Consent. You have the right at any time to withdraw your consent to have the Agreement provided to you in electronic form. Should you choose to withdraw your consent to have the Agreement provided to you in electronic form, you will no longer be enrolled in the Services and you will not be able to access Website. We only will re-register you in the Services after we receive a signed copy of a non-electronic version of the Agreement and the enrollment form, which we will send to you upon request.     Your withdrawal of consent will be effective within a reasonable time after Company receives the notice described above, and it will not affect any action taken in reliance on your consent or the continuing enforceability of the Agreement.

In order to access and retain this Agreement, you must have access to the Internet, either directly or through devices that access Web-based content, and pay any fees associated with such access. In addition, you must use all equipment necessary to make such connection to the Internet, including a computer and modem or other access device.

Please print a copy of the Agreement for your records. To retain an electronic copy of the Agreement, you may save it into any word processing program. We will notify you of any changes in the hardware or software requirements needed to access or retain the Agreement that create a material risk that you will not be able to continue to access or retain it.
